Macbook changing ...?:(?

hi everybody, i ve bought a macbook pro 3 weeks ago from fnak ( electronic store in athens). when i ve opened my mac i ve seen that the batteries health was at 95%. 1 week after i bought my mac i ve seen that the new macs are comming out. well my question is can i go to fnak and REQUEST the new macbook pro.? because they gave to me a macbook pro with problematic batterie and i ve paid 2000$. Can i do that?
